These Terms govern your use of the Breathe app and website (the “Service”) provided by Humberto Pedraza.

Health & safety notice. Breathe is a wellness and relaxation tool, not a medical device, and does not provide medical advice, diagnosis, or treatment. Breathing exercises — especially breath holds — can cause lightheadedness or fainting. Never practice while driving, operating machinery, or in or near water. Stop immediately if you feel unwell. Consult a qualified healthcare professional before starting, particularly if you are pregnant or have any cardiovascular, respiratory, psychiatric, or other medical condition. You use the Service at your own risk.

1. Acceptance

By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes.

3. Accounts

Some features require an account. You are responsible for the accuracy of your information and for safeguarding your credentials and all activity under your account.

4. Subscriptions & billing

Premium features are offered through auto-renewing subscriptions billed via the Apple App Store or Google Play.
Your subscription automatically renews at the then-current price unless canceled at least 24 hours before the end of the current period.
Manage or cancel your subscription anytime in your App Store or Google Play account settings; the cancellation takes effect at the end of the current billing period.
Except where required by law or store policy, payments are non-refundable. Refund requests are handled by the applicable app store.
Prices, plans, and features may change; we will provide notice as required by law or store rules.

5. Acceptable use

You agree not to misuse the Service, including by attempting to reverse engineer, disrupt, or gain unauthorized access to it, or by using it in violation of applicable law.

6. Intellectual property

The Service, including its content, design, and software, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights other than the limited license above.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Humberto Pedraza will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months before the claim.

9. Termination

We may suspend or terminate access if you violate these Terms. You may stop using the Service at any time and delete your account.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

11. Changes

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
